It appears that I was wrong about the Coupe’s next move following Judge Ibarra’s rulings.They can file an appeal with the Hawaii Intermediate Court of Appeals, not file a motion for reconsideration with the Hawaii Supreme Court or petition the US Supreme Court as far as I understand.The Hawaii appellate courts have not had their opportunity to express their opinions on Judge Ibarra’s latest decisions.Hopefully Hawaii County and Hokulia will request that this appeal be transferred to the Hawaii Supreme Court to expedite the appellate process if this is the case.
On that note,attorney Robert Thomas blogged here his take on Judge Ibarra’s recent decisions.
The legislature raided yet another special fund to balance the State of Hawaii’s budget. This is utterly ridiculous that legislators have done this. Especially since the enhanced 911 service has largely been rolled out statewide. The legislature should be refunding these excess funds to cellular phone subscribers instead of reducing budgetary shortfalls.
I hope someday that ferry service between the Hawaiian islands is restored.There is a definite need for passenger and vehicular ferry service between the islands. The latter is critically important to break our dependence on Young Brothers and the inter island airlines.
The Kamakoa Workforce Housing project in Waikoloa has allegedly not been repossessed by the county according this WHT letter to the editor.As a taxpayer I hope somehow the truth about what is really going on with this project comes to light.
Lastly, hat tip to Damon Tucker for blogging here about yet another Hawaiian Sovereignty scam.
“IMPORTANT PROVISIONS OF THE RESTORATION CONSTITUTION INCLUDE:
* Return of all lands in the Hawaiian Islands to the ownership of the descendants of the original Kanaka Maoli owners and users of the lands prior to the invasion and overthrow of the Kingdom’s government in 1893.
* Voids all foreclosures in process on date the Constitution is adopted, and prohibits the commencement of new foreclosures thru December 31, 2010.
* Sets maximum residential mortgage loan interest at 7.5% and modifies all existing residential mortgage interest rates to a maximum of 7.5%.
* Establishes the minimum wage for all workers at $12.50 per hour.
* Abolishes all income taxes.
* Real estate taxes on residential properties may not exceed one-third of the tax rate applied to business properties, and prohibits increases of residential properties assessment value until sold.
* For an elected President and Vice President and for a Parliament made up of Na Kupuna Council (5 members per island) and a Citizens Assembly (12 members per island).”

The leg is famous for setting up special funds for use at a later date. The raiding was just planing on their part.
