Mamalahoa (Hokuli’a) Bypass Land Condemnation Appeal Update
The First Annual Hawaii Airshow Invitational is scheduled for this weekend. I’ll hopefully see the static display aircraft (especially the B-1B Lancer) when we fly to Molokai on Sunday.
Dave Hein, the Hawaii Island DOT Airports District Engineer, created a new blog site. He posted several pictures of the static aircraft on display for the upcoming airshow at Kona Int’l Airport.

The U.S Supreme Court accepted the Coupes application on May 25th, 2011. They have until July 14th, 2011 to petition the Court to hear their Hokuli’a (Mamalahoa) bypass land condemnation appeal.
The DCCA CATV division finally posted a updated timeline detailing the upcoming schedule for the renewal of Oceanic Time Warner Cable’s Big Island cable franchise license .
Lastly, Isemoto Contracting may resume construction on the channelized intersection above Hualalai Vistas subdivision in the near future.
The Kona Blog Will Be On Vacation For A Week
The manager overseeing the Makalei Fire Station project e-mailed me this update:
“Site excavation work is continuing. Contractor is expected to begin trucking material out of the site. The excavated material will be trucked to the Ane Keohokalole Hwy project for use there. We’ve obtained most of the permitting with the DOT right-of-way permit still outstanding, but that should be taken care of soon. Otherwise things are moving along.”
Dave Gedeon, the Saddle Road improvement project manager, e-mailed me this update regarding the last Hilo phase (between m.m 5.3 and m.m 11).
“Aaron – we are working on the R/W acquisition in conjunction with HDOT. Its difficult to predict when all of the needed rights of way will be obtained given there are so many property owners but if all goes well, hopefully by the end of the year. Design is finished and we have most of the permits.”
The Hawaii County DPW recently approved Nan Inc’s Palani Road traffic control plan. However, Nan won’t start utility conduit trenching between Henry Street and Kamaka’eha Ave. until the surrounding businesses and residences are notified. This process will likely take a few weeks. I’ll post update when Nan or the county notifies me of any changes.
I’m still waiting for my DLNR contact to e-mail me the updated TMT CDUP contested case hearing schedule.
Lastly, I won’t be blogging from May 30th until June 7th. I’ll be visiting Molokai with my girlfriend.
**Commentary** Hawaii County Budget Tap Dance
The most recent phase of the County’s annual budget skirmish concluded on 18 May with some interesting outcomes. Regardless how one views the Council actions this year, I feel we’ve done a little better than our normal “rearranging the deck chairs on the Titanic” routine. Hours of discussion and testimony did recommend some amendments to the Mayor’s second budget, although I’m not certain the Council did enough to warrant unanimous applause.
Council members have criticized the Mayor’s budget submissions this year as deferring expenses rather than saving anything. I agree. The Mayor deferred some $29M in expenses to other budget cycles. If those deferments were added to his proposed budget of $367M, that would mean the budget would total approximately $396M. Not much of a ‘savings’ in my opinion, in fact somewhat higher than our current fiscal year budget of $374M. But I don’t disagree with all of the Mayor’s proposed deferments, particularly those associated with debt service payments and the payroll delay. Those are reasonable one-time deferments and are common budget mechanisms employed by almost all other government entities.
The complete elimination of the GASB45 payment is another issue, however. As indicated previously, I called for at least a partial use of the GASB45 expense as a ‘bill-payer’ in prior-year budget skirmishes. I was sharply criticized, told it would cost the County in penalties, that it violated some rules, and otherwise I was dismissed completely. This year, GASB45 becomes the Mayor’s ‘salvation’ and source of the largest deferment that balances his budget. What a difference a year makes!!
The Council in its deliberations focused on the GASB45 elimination. I maintain a partial deferment is OK, but not the entire amount. Towards that end, the Council amended the budget to take $2.7M from the Budget Stabilization Fund, approx. $1M from the Open Space Fund, $200K from overtime accounts, and $5.6M from OCE accounts, the latter amount being referred back to the administration to determine where those cuts would be made. In addition, $500K from the West Hawaii Golf program could also be used as an offset to the GASB45 deferment. In total, the Council decided that the $29M deferment proposed by the Mayor be divided into thirds: we left approx. one third or $9M alone (the payroll delay and the debt service payment). We added back approx. one third or $10M to the GASB45 account. And we agreed to defer one third or $10M of the GASB payment.
Are we happy? Maybe not, but as I mentioned previously, we did a little better than rearrange deck chairs, even though we did kick a sizeable ‘can’ down the road a little. I’ll admit I wasn’t overly excited about referring $5.6M back to the Mayor, requesting that he tell us where the cuts be made. I would have been more pleased if the Council determined the location of these decreases. But in previous budget discussions we did suggest some compromise on a variety of budget issues (Hamakua land sale, GASB45 last year, hiring freeze, and a more aggressive elimination of most vacant funded positions, to name a few), none of which met with favorable consideration. Whether or not we can consider this ‘throwback’ normal budget procedure is arguable, but there seemed to be little recourse to insure that some reduction in the $29M deferred expenses is made.
And exactly what is the result of this “budget tap dance?” Since no one chose to address the “800 pound gorilla” in the room (personnel costs), the $10M in Council amendments adds up to a little less than a 3% adjustment to the Mayor’s budget (that totals $367M). Unless some significant change occurs at the next Council meeting on 1 June, we amended a few items and agreed to most of the administration proposals. The question now: if the budget passes second reading on 1 June, will the Mayor accept the less than 3% in changes made by the Council or will the deck chairs be returned to their original positions?

Hokuli’a (Mamalahoa) Bypass Land Condemnation Update
The Coupes filed an application with US Supreme Court requesting an extension. They’ll have until July 29th, 2011 to petition the Court to hear their Hokuli’a bypass land condemnation appeal (if their extension request is granted).
WHT published this article regarding the next phase of the Saddle Road improvement project last Friday. I wouldn’t be surprised if the CFLHD splits the earthwork portion into two bid solicitations. The current Hawaii DOT STIP allocates 75 million dollars towards this project spread over FY2012 through FY2015. I doubt there is enough funding to complete all the earthwork under one bid solicitation. However, the weak construction industry has resulted in a lot of competitive bids. So, stay tuned….
The CFLHD is likely working on obtaining the necessary permits and right of way for the last Hilo phase (between m.m 5.3 and m.m 11). This is probably why they didn’t put this phase out to bid yet.

Lastly, Rep. Denny Coffman e-mailed me this synopsis of a recent meeting he had with the Hawaii DOT regarding the Queen Kaahumanu Highway phase II widening project.

Good meeting. Learned that: 1. Feds are paying for the planning and design of what is called roads A and B inside of NELHA. 2. HDOT is authorizing a four-way intersection at Ka’iminani intersection that can connect to road A and provide access into and out of NELHA. The four-way intersection at Hulikoa Drive has been authorized with impact fees being paid by the Kohanaiki business park and Shores at Kohanaiki developer. I have a map back in my Capitol office. Palani Road Utility Pole Relocation Update
The future Keahuolu Interpretive Center is now scheduled to be completed by the end of 2011. Nan Inc. originally planned to complete this facility by late summer.
HELCO’s pole relocation project alongside Palani Road is progressing, according to the manager overseeing the Ane Keohokalole Highway project.
“Update on the Palani pole line – the HELCO field crew have stepped up their effort not to delay the current work schedule. Crews have been working extended hours and overtime to recover time lost due to thunderstorms (bad for working on power lines and around steel poles), and a slew of emergency repair responses resulting from the recent heavy rains. They will again be working tomorrow (Saturday) to remove the conductors from the old wooden pole line, and believe they will be able to finish the remainder of their work, on schedule, by the end of the month.”
Nan Inc. asked the county to reconsider their traffic control plans for the Palani Road utility conduit trenching. I’ll post update when Nan or the county notifies me.

I’ve wondered why several Asian investors started receiving a return on their investment in The Villages at Aina Le’a development. Steve Dunnington, one of the managing partners of DW Aina Le’a Development LLC, informed me these were interim payments. However, it doesn’t make any sense why these individuals get paid while there is a slew of local contractors who haven’t been fully compensated yet.
Lastly, I recently spoke to Rep. Cindy Evans. She informed me HR204 received a slew of supportive testimony (State House resolution supporting The Villages at Aina Le’a project). However, they weren’t officially posted because the resolution failed to get a hearing.
