Recent Court Ruling Helps Thirty Meter Telescope Project

Willocks Construction recently completed roadway improvements around Honokohau Harbor. Global Specialty Contractors is working on waterline improvements in this area though.

The Hawaii Intermediate Court of Appeals recently upheld Judge Hara’s dismissal of KAHEA, etc’s Mauna Kea Comprehensive Management Plan appeal. KAHEA, etc requested a contested case hearing after the BLNR approved the Mauna Kea CMP in 2009. The BLNR denied KAHEA, etc’s petition. They consequently appealed this decision to the Third Circuit Court.

This ruling is a huge boost for the Thirty Meter Telescope project. Judge Hara previously mandated that a comprehensive management plan be enacted before any new telescopes are built on Mauna Kea.

The HDOT delayed opening bids for the Mamalahoa Highway resurfacing project between Makalei and Palani Junction until February 3rd, 2012.

I was very pleased after the legislature tabled legislation, which would’ve forced ISPs to keep records of the web surfing habits of their subscribers for two years. However, we’re not out of the woods yet as this legislation could reappear later on during the current session.

Lastly, Sandwich Isles Communications recently filed a motion asking the FCC to stay its September 29th, 2010 Paniolo Cable Company subsidy decision. NECA and AT&T Corporation filed motions (here, and here) against the FCC granting SIC’s motion.


Ane Keohokalole Highway Project Update

I’ve arranged to get Ane Keohokalole Highway project updates through the county from now on.

The new Palani Road sidewalk/curb/gutter is nearly complete. Nan is slated to begin pouring cement for the new Ka’u side travel lanes starting November 28th. This phase may take up to three months to complete. They’ll shift traffic to the new Ka’u side lanes after the concrete cures. Then Nan will demolish the existing pavement and pour additional cement.

The Indian government will contribute 158 million dollars towards the construction of the Thirty Meter Telescope on Mauna Kea. I hope this game-changing facility gets built. However, I’m concerned the anti-Mauna Kea telescope activists may derail it. They want the BLNR to rescind the TMT’s CDUP. In addition, they’re trying to reverse the BLNR’s Mauna Kea Comprehensive Management Plan decision. The BLNR denied their petition seeking a contested case hearing in 2009.

Lastly, the State of Hawaii DAGS is seeking bids to construct a new West Hawaii base yard. This new facility will be located in Keauhou Mauka.


Queen Kaahumanu Highway Widening Update

The Queen Kaahumanu Highway phase II widening team recently posted this update on this important West Hawaii roadway project:

“The project has been delayed due to the finding of new archaeological historic sites within the project area. In consultation with the State Historic Preservation Division, National Park Service, the Office of Hawaiian Affairs and several Native Hawaiian Organizations, the State Department of Transportation has been working to revise and update the project’s Archaeological Inventory Survey, Memorandum of Agreement, Archaeological Monitoring Plan, Cultural Monitoring Plan, Data Recovery and Preservation Plan and Burial Treatment Plan. The State Department of Transportation currently estimates construction will start between October 2011 and November 2011.”

A technician from Oceanic Time Warner Cable called me about my recent Road Runner speed issues. I told him I am very happy with the standard Road Runner tier, so a service call wouldn’t be necessary. He informed me they’re actively separating and recombining nodes to address the speed issue. I reiterated Oceanic needs to fix this issue soon or they’ll see more people downgrade their service.

Hawaii County has granted preliminary subdivision approval for The Villages at Aina Le’a project. The county is obligated to approve these plans because they granted building permits for the affordable townhouse units.

However, the developer may run into permitting issues when backbone infrastructure (e.g roads, sewer, electricity, water) construction begins. Hawaii County may deny issuing new permits because the project’s land classification has changed. The developer consequently will barred from selling these units and the plethora of Asian investors won’t see a return on their investment.

The Palani Road water transmission project contractor has requested another time extension. HELCO needs additional time to finish their work. Then CTS Earthmoving can start final testing of the new equipment.

The Thirty Meter Telescope contested case hearing process should be wrapped up by Friday.

Lastly, I wonder if the WHT reporter, who wrote this latest article about the Ane Keohokalole Highway project, has driven up Hina-Lani Street lately. CTS Earthmoving already started excavating this future roadway segment (between Hina-Lani Street and Kealakehe Parkway), although the second to last paragraph makes it sound like nothing has started.


TMT Contested Case Concludes on Friday

The last two witnesses in the Thirty Meter Telescope Contested Case Hearing completed their testimony on Monday, September 26 concluding the evidentiary portion of the quasi-judicial hearing.

Hearings Officer Paul Aoki then recessed the hearings until Friday, September 30 stating that he wanted all parties to have their closing arguments on the same day.

The University of Hawaii will conclude their case on Friday starting at 9 am followed by petitioners at the Komohana Research Extension Center, Conference Room A in Hilo.

If you are able to attend on Friday TMT would certainly appreciate your support for one-hour only from 9 am to 10 am.

TMT Contested Case Hearing Wraps Up Monday

TMT‘s community support throughout the Contested Case Hearings has been tremendous. Mahalo!

The Contested Case Hearing is scheduled to wrap up next Monday, September 26 in Hilo starting at 9 am. The hearing will be held at Komohana Research Extension Center, Conference Room A on Komohana Street.

We again need your support. If you are able to attend the hearing, even if you have an hour or two, it would be much appreciated.

Hawaii Road Runner Speed Issue Update

Oceanic Time Warner Cable‘s V.P of Operations provided an update regarding the ongoing Road Runner speed issues. They’ve ordered new head end equipment to resolve this issue. However, it will take some time to integrate the new hardware.

I hope Oceanic resolves this issue soon. My Road Runner speeds remain anemic.

The Miller Starr Regalia law firm published a commentary regarding the 2005 Kelo v. City of New London U.S Supreme Court ruling. It mentioned the ongoing Coupe land condemnation case.

The Coupes assert the Mamalahoa (Hokuli’a) bypass is being built for solely Hokuli’a's benefit. However, the public, not Hokuli’a, will reap the benefits from this bypass. Judge Ibarra and Hawaii Supreme Court have affirmed the roadway’s public purpose in 2007, 2008, and 2010.

I hope the U.S Supreme Court denies the Coupes petition at their September 26th conference. This litigation has dragging on for far too long.

I called up Kirkland Construction again a few days ago. They never returned my phone call which I made on August 25th, 2011. The receptionist told me they’ve been busy preparing for the upcoming Saddle Road project and haven’t gotten around to returning phone calls. She also asked me to be patient and wrote down my contact information again.

Damon Tucker blogged about the outcome of today’s Court hearing. The HCPD charged him with interfering police duties after allegedly assaulting him for videotaping an arrest.

Lastly, the Thirty Meter Telescope has amassed widespread support in my ongoing poll. 97% of the respondents support this project.
